General Conditions of Sale (GCS) – Most recent
1. Purpose
These General Conditions of Sale (hereinafter "GCS") concern the rights and obligations of the company Newer, a self-employed company, registered with the Toulouse Trade and Companies Register under number [SIRET/SIREN] (in progress), whose head office is located in Toulouse, and of any adult natural person (hereinafter "the Customer") making a purchase via the website newerapp.com.
2. Scope of application
The T&Cs apply to all orders placed on the Newer website, in France and internationally.
Validation of the order by the Customer implies full and complete acceptance of the present General Conditions of Sale, which prevail over any other document.
3. Products
The essential characteristics of the products are presented on the site. The photographs and descriptions are given for information purposes only and have no contractual value.
Newer reserves the right to modify the product offering at any time.
4. Orders
The order is considered final after:

validation of the basket by the Customer,

acceptance of the T&Cs,
-
confirmation of payment.
Newer reserves the right to refuse or cancel any order in the event of a prior dispute, non-payment or suspected fraud.
5. Price
The prices displayed are indicated in euros including all taxes and excluding delivery costs, unless otherwise stated.
Delivery costs are specified before validation of the order.
Newer reserves the right to modify its prices at any time, but the rate applied is the one in effect at the time of the order.
6. Payment
Payment is due immediately upon ordering, by credit card, bank transfer, or any other secure method offered on the site.
If debit is not possible, the order will be automatically cancelled.
7. Delivery
The products are delivered to the address indicated by the Customer when ordering.
Delivery times are specified before validation and may vary depending on the carrier chosen.
In the event of a delivery delay of more than 30 days, the Customer may cancel their order and obtain a full refund.
The risks associated with transport are borne by the Customer from the moment the package is handed over by the carrier.
8. Right of withdrawal
In accordance with Articles L221-18 et seq. of the Consumer Code, the Customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to provide a reason.
The Client must inform Newer of his decision in writing (email or online form).
Return costs are the responsibility of the Customer, except in the case of a defective product or a more recent error.
The product must be returned in its original condition, complete and undamaged, in its packaging.
Exceptions to the right of withdrawal: personalized products, sealed products that cannot be returned for hygiene reasons (e.g. cosmetics, underwear) once opened.
9. Refunds
In the event of withdrawal or validated return, Newer will reimburse the Customer within a maximum of 14 days from receipt of the product or proof of its dispatch.
The refund is made via the same payment method used for the purchase.
10. Legal guarantees
All products sold by Newer benefit from:

The legal guarantee of conformity (articles L217-4 to L217-14 of the Consumer Code), valid for 2 years from delivery,

The guarantee against hidden defects (articles 1641 to 1649 of the Civil Code).
In the event of a defective product, the Customer may request repair, replacement or, in the event of a defect, reimbursement.
11. Liability
Newer cannot be held responsible for damages resulting from improper use of the products by the Customer.
In the event of force majeure (strikes, disasters, network failure, etc.), Newer cannot be held liable.

Newer collects and processes Customers' personal data in accordance with the GDPR.
The Client has the right to access, rectify, delete and oppose by writing to: [contact email address].
13. Intellectual Property
All elements of the site (texts, images, logos, brands, etc.) remain the exclusive property of Newer.
Any reproduction, exploitation or use without authorization is prohibited.
14. Applicable law and jurisdiction
These T&Cs are subject to French law.
In the event of a dispute, the French courts will have sole jurisdiction, unless otherwise provided by law.
The Consumer Client may also be used free of charge for consumer mediation before any legal action.
